Child Custody and Support ProceduresChild custody is usually determined based upon the best interests of the children. Couples can try to reach an agreement amicably without having the court decide for them but if this is not possible, the court will decide. Usually the person who has stayed at home with the children will receive custody. Having our attorney with you at the child custody hearing is important as he can ask questions that are important in helping the court determine custody. Child support is based upon guidelines. The income of both the custodial and non-custodial parent is used to determine the amount that is to be paid. Other factors include spousal support, insurance costs, childcare expenses, and the length of actual custody for the custodial parent. Child support usually continues until the child turns 18.
